Mumbai hit-and-run case: Minor driver’s father booked for negligence | Mumbai News

MUMBAI: A month-and-a-half after a 63-year-old Chandivali resident in Mumbai was knocked down by a speeding MUV car outside the Orchid Enclave building on September 6 that was driven by a 14-year-old school student, the police has registered a first information report (FIR) against the Saki Naka-based businessman, Shamsool Khan (40), who was allegedly found at fault during the probe.

Saki Naka police booked Khan on Saturday after they found out during the investigation that he did not keep the car keys in a safe place and knew his minor son used to take the vehicle out for a spin resulting in the accident on September 6 evening.
The minor’s father, Khan, has been booked under several sections of the Indian Penal Code (IPC) for rash driving, grievous hurt by act endangering life, and under the Motor Vehicle Act sections allowing unauthorised persons to drive vehicles, no person shall drive a motor vehicle in any public place unless he holds an effective driving licence, no person under the age of eighteen years shall drive a motor vehicle in any public place), dangerous driving, and offence committed by a juvenile, the guardian of such juvenile shall be deemed to be guilty). “The case has been registered against Khan after the probe showed negligence on his part. He kept the vehicle key at home which had access to the minor son. Khan is yet to be arrested,” said Saki Naka police senior inspector Gabaji Chimte.

The accident occurred on September 6 at 4 pm when Khan’s son took his MUV car out for a spin and knocked down a corporate legal advisor, Subharaman Krishnan (63), a resident of Orchid Enclave ‘C’ wing on Nahar Amrit Shakti Road in Chandivali. The juvenile stays with his parents in another wing of the same building where Krishnan resides. The closed-circuit television (CCTV) footage of the accident went viral with over 2 lakh views after it was tweeted on X (formerly Twitter) by the Chandivali Citizens Welfare Association (CCWA) showed the minor at wheels lost control as soon as the MUV moved out of the building gate took a sharp left and immediately brushed a parked auto rickshaw before knocking down Krishnan who suffered two fractures on his spine (L1 and tailbone).
Krishnan confirmed TOI on Sunday that the police have finally registered a case against the minor’s father. However, he is still unhappy with the way the police have handled the case.
“It is unclear what action the police have taken against the juvenile and whether they have asked the regional transport office (RTO) to not issue a driving licence to him till he attains 25 years. Also, what action has been taken against the minor by the Juvenile Justice Board (JJB) if the police have submitted any report,” he said.
He said, “Though I survived the knocks, for an initial month I was completely bedridden. Now I have started using a walker to walk slowly inside my house. I had appointed a person to look after my daily activities. I was knocked twice by the car that was driven by the minor who resides in the same building’s A-wing.”
DCP (Zone X) Datta Nalawade has said that the Saki Naka police will send the minor’s Social Survey Report (SSR) to the Juvenile Justice Board after a probe is completed. The Saki Naka police have written to the regional passport office (RTO) to bar him from issuing a driving license till he turns 25.
