NEW DELHI: Shahrukh Pathan, the man who gained notoriety for brandishing a pistol at a police officer and making threats during the 2020 northeast Delhi riots, was granted bail on Saturday. However, Pathan will not be released from custody immediately as he is also facing charges in another rioting case.
Additional sessions judge Amitabh Rawat delivered the bail order in response to a plea from Pathan. Pathan was accused of being part of a violent mob that caused gunshot injuries to an individual near Maujpaur Chowk on February 24, 2020.
In his ruling, ASJ Rawat considered the overall circumstances of the case. He noted that Shahrukh Pathan had been in custody since April 3, 2020, and the case had reached the stage of prosecution evidence. One of the key witnesses, Rohit Shukla, who was injured in the incident, had already been examined. The remaining witnesses were all police officials. Furthermore, the judge pointed out that all other co-accused persons had been granted bail. Consequently, ASJ Rawat approved Shahrukh Pathan’s bail application.
As a condition for bail, the court directed Pathan to provide a personal bond of Rs 50,000 along with two sureties of the same amount.
It was emphasized in the court’s ruling that Shahrukh Pathan did not directly shoot the victim, Rohit Shukla, but he was alleged to have been present in the mob that carried out the shooting.
The court also took into account that Shahrukh Pathan was involved in another rioting case (FIR No.51/2020 at Police Station-Jafrabad) where he was accused of attacking a police official. However, the court decided to address this case separately, based on its specific circumstances.
During the legal proceedings, the public prosecutor highlighted Pathan’s disruptive behavior toward jail staff and his tendency to file “false and fabricated applications” against them. In response, the judge acknowledged Pathan’s problematic conduct but pointed out that he had been in judicial custody since April 3, 2020.
The Jafrabad police station had filed an FIR against Shahrukh Pathan and others, charging them with various IPC provisions, including rioting and attempted murder. These charges were formally framed against them in December 2021.
